What is bail?

Bail is essentially an insurance policy with the judicial system to guarantee you will be present for future court hearings. Bail is set by a judge at your husband’s first appearance, also known as an arraignment. During this hearing your husband will be read his charges against him, his right to a speedy trial and right to an attorney. If you can’t afford an attorney, your husband will be appointed a public defender. The judge will also set bail at this time. Bail is determined based on several factors, including ties to the community, employment and how likely you are to skip town and your court hearings.

How do I pay for bail?

You have several options. You can pay cash directly to the courts. However, we know paying for the total bill out of pocket is not realistic for many families. Another option is to work with a third party, such as Rush Bail Bonds. To post the bail, you’re husband will need a co-signer, collateral and money to pay for a non-refundable fee. Rush Bail Bonds charges between 10%-15% of the bail amount. For example, if bail is set at $20,000 you would need to only pay $2,000-$2,500. In addition, we need collateral. This is typical across the board with bail bonding service companies. Collateral is essentially anything of value. We accept jewelry, bank accounts, property and even cars as collateral. After you accept the terms of our bail bonding service, we contract with the court to secure your husbands release.

My Husband is out of jail!

Thank you! Now what? Great question. Now that your husband is out of jail, its imperative he stay out of trouble and show up to every court hearing. If you’re unsure of his next court hearing call his attorney or public defender. If your husband fails to show up to future court hearings and violates the specific terms of his release, then his bail could be revoked and a new arrest warrant issued. If this happens, then Rush Bail Bonds will become financially responsible for the total bail amount. At this point, we would begin collecting the collateral you posted as part of our agreement. This means your home or property could be sold, if this was part of the collateral you signed on the contract. We hope it never reaches this point. As a co-signer you are also responsible to make sure your husband is staying on top of his case.
